TERMS AND CONDITIONS
These Terms and Conditions (Terms) govern the use of www.thechristmastreeexpress.com.au (The Website) operated by The Christmas Tree Express.
Access and use of The Website by all visitors and users is provided upon acceptance of the following Terms.
1. Purchases
(a) To make a purchase of any product available through the website, you may be required to supply certain information relevant to your purchase.
(b) You represent and warrant that: (i) you have the legal right to use any credit card(s) or payment method(s) used to facilitate any Purchase, and that (ii) the supplied information is true and correct.
(c) By supplying such information, you grant The Christmas Tree Express the right to provide information to third parties for the purpose of completion of the purchase(s).
(d) The Christmas Tree Express reserves the right to refuse or cancel any purchase in the event of suspicious transaction activity including fraud, unauthorised or illegal transactions.
(e) Upon purchase of any product, you (The Customer) agrees to the Terms as listed.
2. Purchases under our "Reserve Now, Pay Later" (Pre-Order) Framework
(a) The Pre-Order Framework requires a reservation fee of $20 (Reservation Fee) to be made at the time of the Transaction. The full invoice (less the Reservation Fee) will be automatically processed on 20 November 2025 (Amount Payable).
(b) All sales made under our Pre-Order Framework are final. We will not offer refunds of the Reservation fee for change of mind, circumstances or otherwise, that occurs on the part of The Customer.
(c) We operate under a strict no-cancellation policy. Payment of Reservation Fee is taken as an express intention to be bound by the Terms of this Agreement, including an Agreement to be liable for the Amount Payable. Only at the discretion of the Christmas Tree Express may this liability be waived. A Customer will be liable for the Amount Payable irrespective of any changes of mind, circumstances, or otherwise, that may occur between the date of purchase and the date that full payment is effected.
3. Pick-Up
(a) If you have nominated to pick up your Christmas Tree you are able to select your tree. Please note a selection can only be made from the products available.
(b) The trees are available for Pick-Up from the 29th of November 2025.
(c) If you are not able to collect your tree on the nominated dates, please contact The Christmas Tree Express at your earliest convenience and we may be able to arrange an alternate delivery for an additional fee.
4. Deliveries
(a) If you have nominated for delivery of your tree, please keep up to date with the information posted on The Christmas Tree Express Facebook page and sent to you via your nominated email.
(b) If you cannot be home at the time of delivery, please arrange for someone else to be there, or ensure that there is a suitable place for the tree to be left. For example, a bucket or stand with water. You will be notified once the tree has been delivered. Additional delivery instructions will be sent to you, via email mid-November.
(c) If the tree is unable to be delivered, you will be responsible for payment of an additional delivery fee so that a new delivery date can be scheduled at our earliest convenience.
5. Special Requirements
(a) Please advise us at the time of ordering if there are any special requirements to consider with the purchase and delivery of the Christmas Trees. We will do our best to ensure that all requirements are fulfilled to the buyers’ satisfaction.
(b) There is no guarantee that special requirements can be fulfilled if proper notice to The Christmas Tree Express is not given.
6. Competitions and Promotions
(a) Any tree purchase completed by way of promotion or competition winnings (competitions) conducted by The Christmas Tree Express may be governed by additional or separate Terms to those contained within this agreement. You will be advised of any such terms upon engaging in competitions endorsed by The Christmas Tree Express. Upon participating in any competitions, the customer should review the applicable rules.
7. Returns and Refunds Policy
(a) The Christmas Tree Express does not offer returns or refunds. If you are unhappy with the quality of your tree, please contact our staff and we will do our best to ensure that this issue is not repeated.
(b) The trees are expected to last approximately 4 weeks. We cannot guarantee the longevity of any purchased trees.
(c) We deal with each complaint seriously and separately. If we feel that there is a legitimate issue with your tree, we may offer a partial credit. In this case, the buyer will need to present their invoice or proof of purchase.
(d) If you would like changes or alterations to be made to your invoice, please contact our staff and we will do our best to enact these changes. We deal with each situation separately and on a case by case basis.
8. Limitation of Liability
(a) For service by delivery, The Christmas Tree Express is not liable for any damage caused to or by any product or service once the product enters the premises of the nominated address.
(b) For pick-up services, The Christmas Tree Express is not liable for any damage caused to or by any product or service once the product has been collected by the buyer.
9. Privacy
(a) We respect that personal information collected by The Christmas Tree Express is confidential and will not be passed on to any third party.
10. Availability, Errors and Inaccuracies
(a) The information included on this website is constantly being updated. The products or services available on the website may be different from the photographs, mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Website and in our advertising on other websites.
(b) We cannot and do not guarantee the accuracy or completeness of any information that appears on the Website at any time, including prices, product images, specifications, availability and services. We reserve the right to change or update information, correct errors, inaccuracies, or omissions at any time without prior notice.
11. Links to Other Websites
(a) The website may contain links to third-party websites or services that are not owned or controlled by The Christmas Tree Express.
(b) The Christmas Tree Express has no control or responsibility for the content, policies, or practices of any such sites or services. The Christmas Tree Express shall not be liable for damage or loss caused by or in connection with the content goods or services available on or through any linked websites or services.

(a) The Christmas Tree Express reserves the right, to, at their discretion, amend (by removal, addition or editing of) these Terms at any time. If you continue to access the website after these revisions, you agree to be bound by the revised terms.
